i sold my home to a relative and the house had a second mortgage. i gave him the power of attorney to handle the business end because i was in another state. the 2nd mortgage was not incorporated into his mortgage. is that legal? now i'm still getting bills from the 2nd mortgage lender and they are not aware that the house had been sold. this has been over 6 years ago.
I guess buyer beware needs to also incorporate "seller beware."
Were you never getting bills from the second mortgagee? Did you not receive any copies of the closing paperwork to ensure that your interests were protected? Did you not have a lawyer?
I'm afraid the lender is going to be able to enforce its lien on the home, since it's never been released. You will be wise to engage the assistance of legal counsel to try to wend your way through this.
