Short sale & left w/2nd Mortgage:How do I settle?

I have a second mortage with a remaining balance of 116K. I did a short sale and they left me with the remaining balance on the second. The short sale was in Jan 2009 and i have not made a payment because i can't afford it. The home that the second was apart of is gone and that was the income to pay the second. I am in the recovery dept with the bank and I need to settle? What do I do?

Though your property was short sold by the first lender, the second lender can still sue you for the dues. He has all the right to collect his dues from you. As the property has already been short sold, he has send your account to the recovery department. Now, you'll have to negotiate with the recovery department regarding the payments. I'm doubtful whether or not they would forgive the whole amount. However, you can definitely negotiate so that they reduce your dues to some extent.

Thank u for the response. They want 24K to settle and I owe 116,000. Is that a good deal?
How do I pay them? 50% up front then payments?
