2 brothers own a home, that was left by the parents. The estate has been settled for 3 yrs now. One brother wants to pull his interest, out and thinks it will create a gift tax burden. We are in Tennessee. Can we just use a quit claim form?

As far as I know, both the brother's may have to file an affidavit of heirship at the county recorder's office and get the property transferred in their names. It will be a better option to consult an attorney and take his opinion in this regard.
