I am 90 days late I have tried everything to negotiate.

Lenders do not generally start foreclosure proceedings unless you have missed 3-4 payments. It is thus strange that your lender started foreclosure even though you just missed 1 payment. It is even stranger that your mortgage company rejected your payments when you tried to make up for the missed payment. But since they have now agreed to accept the payment, you can talk to them regarding the attorney fees. Once you get current on the loan and make your payments on time, the lender might not ask for the fees anymore.

no matter what your situation is, if you are not in conversation with your lender, they'll not play around with you. you need to keep them posted on your situation, let them know when you can make a payment, and fix it if you are not able to carry through on a promise.
yes, these servicing people can be annoying when you get them on the phone - outsourcing is not only taking jobs away from us, but common sense goes out the window too - but you still have to deal with the folk who (eventually) answer the phone, and let them know what your plan is, if you have one, or not.

Are late payments over 90 days considered as foreclosure
When a person defaults on his loan for 90 days, the lender has the rights to start foreclosure proceedings.
My Mortgage went 90days pass due sept 30....I have not gotten a letter or anything I live in TX, how long do I have b4 I have to move.

I'm in Ks and I am late on house payments I am now only 1 1/2 months behind and been working on getting all caught up. I told the owner and he said since I was behind that he was going to proceed with proceedings on default. I will have it all paid in two weeks. What can I do to stop him???

You should negotiate with the owner in order to convince him so that he doesn't foreclose the property immediately. You should tell him that you will be able to pay off the dues in full within 2 weeks. Hopefully, this will convince him to stop the foreclosure for the time being.

I have lost my job but I pay 550 which my mortgage is 756 can they still foreclose on my house if I don't pay the full amount
