Hi MBOTELLO,

You and your siblings will file an affidavit of heirship and get the property transferred in your names. Then all the siblings can sign a quitclaim deed and transfer the property to the third sibling.

Thanks

Hi fernnado,

Your mother will have to file an affidavit of heirship at the county recorder's office in order to get the property transferred in her name. Then she can sell off the property.

Please do not file a quick claim deed. File a Special Warranty Deed.

Hi Sis groves,

I agree with you that filing a warranty deed is always a better option than filing a quitclaim deed. Warranty deed is much safer compared to any other deed.

I will be buying a land next to my house. My neighbor says she needs to file affidavit of heirship and then the property/land can be transferred to my name. About how long will it take for this process? I live in TX.

Hi Connie!

Welcome to forums!

I haven't heard about the time frame but as far as I know, it won't take much time to complete. Nevertheless, you can get in touch with a real estate attorney and he will let you know the time frame.

Feel free to ask if you've further queries.
