Why do I have to be present in Texas to sign closing documents?

Posted on: 12th Jun, 2011 04:40 pm
I am buying a HUD owned home in Austin, Tx. for investment and I reside in California. I am told at this last minute that I must be present in Austin, Tx to sign the closing and loan documents costing me some extra $1,800. The lender will not accept a Power of Attorney. Is there another way? Why won't the Title office accept a notarized document package?
Thank you.

Hi gonesouth!

Welcome to forums!

It is the lender's discretion. It will depend upon the lender whether or not he will accept the power of attorney. You can request the lender to consider your situation and accept your request.

Feel free to ask if you've further queries.

I have signed many loans, over seas and out of state. The escrow for your transaction should have the ability to overnight your loan docs to a notary in CA and have the package signed and notarized and overnighted again back to Texas. This makes no sense, would they require a military personnel to come home from deployment???
