I paid off my Mortgage with CITI they sent me a letter stating they would file the release of lien with my county clerks office. it has been over 90 days several letters and numerous phone calls but no release - is there any law that says the must file in a certian amount of time? I have a cash buyer for the home and he wants a clear dee. I live in Texas
releases ought to be done on a timely basis. i don't know of any limitation on time per se, but it might just be worth your trouble to have an attorney contact them on your behalf to stress the urgency. or just raise a little hell in asking for it. or something.
i'd be surprised to find out that they sent it directly to the land records; generally i believe they'd go to you, the borrower, and it would then be up to you to file it, with the required fee.
