Unsure what to file, Warranty Deed or Quit Claim Deed

my husband and i are going through a divorce, both of us are currently on the deed to the house. i am taking possesion of the house. what do we need to file in texas, (a warranty deed or a quit claim deed) to take him off the property deed and for him to relinquish any interest in the house (equity in a future sale)?

i am just beginning this journey, please forgive the possible obviousness of the question.

You will have to ask your husband to sign a quit claim deed and transfer the property to you. I guess there is a mortgage on the property. Once you receive the sole ownership of the property, you will have to refinance the mortgage in your name. This will release your husband from the property ownership and he will not be liable for paying the loan.

Thanks for the reply. Unfortunately, him trashing my credit prevents refinancing at this time (him not paying our bills without my knowledge, hey.. I thought I would be married forever, and trusted the guy)
