I need to file a general warranty deed in houston, texas I don't know where to go?

You will find a number of warranty forms online but it is always better to draft the form by an attorney. The form should be drafted as per the laws in the state where the property is located. You should also get the deed signed and witnessed by legal professionals. If it's a buying/selling transaction, then deed requires to be delivered to the buyer at the time of closing. The buyer then has to record the deed at the County Recorder's office. It should be recorded within a specific period as needed by the state laws so that it is considered as valid. If it is used to transfer title while selling off the property, the buyer should increase the claims by purchasing title insurance policy. Both the deed and the policy will protect the lender and the buyer against disputes on ownership or liens on property.

If the property is in Harris County all deeds must be recorded with the Harris County Clerk's Office at 201 Caroline, 4th Fl.

my aunt died and left me as executrix in her will. there are no claims against the property. i want to transfer title of home to the deceased son. there is no mortgage and all taxes paid up to date. should i file a quit claim deed or warranty deed. the will was probated as decree on muniment of title. we live in houston texas as well as deceased before expiring.

Do you mean you want to transfer the title from the deceased person's name to her son?

Well, if your aunt left a will and the property has been probated then I believe all you need to transfer the title to her son is, file her death certificate and the papers of the probate judgment with the county recorders office. They will change the title to her son's name.

To add a person's name to the deed, you can use a quit claim deed form. Those who already own the property will be required to sign the deed as grantors and transfer the property to the grantees (the person to be added to the deed along with the existing owners). Once the deed has been signed and notarized, get it recorded with the county recorder's office.

I want to file a warranty deed to add my niece's name. But she is chinese. She has no SSN in US. She has passport and visa and a banking account in US. How possible? Thanks.

Hi ziggy,

You need to consult an attorney in this regard. I'm not sure if the laws related to property transfer will allow your niece to own a property in the US. I personally believe that there should not be much of a problem as you are merely adding your niece's name on the title to the property. However, consultation with an attorney is the best option for you in this situation.

To curious,

The warranty deed allows you to add a person to the property title. The deed helps you transfer the property ownership to another person. It does not automatically put that person's name on the title. Once the warranty deed is signed, it needs to be notarized and recorded so that person's name gets added to the property title.

Hi ROBERT,

You need to contact a title search company in order to know whether or not there are any liens on the property. You can even contact the county recorder's office for the same.
