I was set to close on a home this week and received a call the day prior stating that we could not close as my husband has an IRS tax lien. Texas is a community property state, however, Texas also has rather unique protection for homesteaded property from creditors. Doesn't that include homestead protection from the IRS?

As far as I know, a tax lien may be imposed for delinquent taxes owed on real property, or as a result of failure to pay income taxes or other taxes. However, I don't think that a homestead will protect your property from a IRS tax lien. You'll have to pay off the tax lien in full or go for a payment plan with them in order to pay off the taxes. Once you do so, you'll be able to get a mortgage.
