Hi Ya'll,
I live in Katy, Texas [Harris County] and got married a few months ago. I need to change my name on the title as well as add my husband's name on the title.
(1) I called the Harris County's Clerk's office and understand that on the warranty deed, I am the grantor. However, is my MAIDEN NAME the grantor (as the house was purchased under my maiden name)? My husband and I will be the Grantees -- in which case, is this then my married name? So if I am the grantor as my maiden name and the grantee as my married name, do I have 2 different signatures on the form?
(2) Do I have to go to the actual office to submit this form (I assume there will be fees for this claim but it's not listed on the website so I have no idea) or do I have the option to mail it in?
(3) How do I add husband to mortgage -- through the bank I financed or the mortgage broker? I assume this isn't as important so perhaps I don't need to.
(4) Has anyone bought the warranty deed form at Office Depot? I was just going to purchase it there.

i just read through some postings and someone said since there is a mortgage on the property i can't use warranty deed, i'd have to use quit claim deed? i'm soooooooooo confused!!!

It is true that if you've a mortgage on the property, then you won't be able to use a warranty deed to transfer property to someone else. You'll have to use a quitclaim deed in that case. You should contact an attorney and he will help you in drafting the deed. Your maiden name will be listed as the grantor of the property whereas your married name and your husband's name will be listed as the grantees to the property.
