Affidavit of heirship

Posted on: 15th May, 2009 06:19 pm
My mother died last year in Texas, and I could not locate her will. I live in CA. I have an affidavit of heirship, and I am the only surviving person in my family. I have been getting letters from a collection agency, regarding her medical bills. Am I responsible to pay it ? Thank you
Hi pamrod!

Welcome to forums!

I don't think you will be personally responsible for the medical bills. However, if she was on Medicaid, then they can go for a estate recovery to recover the cost of her treatment.

Feel free to ask if you have further queries.

My siblings and I are heir to my deceased fathers house. We went to court and we were proven to be his heirs. Now his wife says we are responsible for half of the mortgage and all billabong incurred since my father died seven years age. Are we liable for mortgage a.d taxes, past and present?

welcome martha,

unless you refinance the mortgage in your names, you're not liable for the mortgage payments. no one can force you for payments unless your names are mentioned in the mortgage docs.
