Bankruptcy , Deed and partner

Posted on: 04th May, 2009 11:17 am
had to file bankruptcy over a year ago. in my name only because loan and mortgage were only my name only. live with partner not common law husband we are not married and we have one child. he is on the deed of home. fails to help me pay home , i do not want to leave my home, or ruin my bankruptcy plan. want to get him to sign a quit claim deed but he refuses to leave or sign or cooperate. how much is it to file a partition suit in texas i want to keep home at least until plan is over 98% of updates and remodeling i have paid for and everything as far as property belongs to me.

please advise
Hi dianajiminez,

If you file a partition law suit, the court will order the sale of the property. Moreover, you have mentioned that your name is on the mortgage whereas your partner's name is on the property deed. In such a situation, I don't think you will able to file a partition lawsuit. I would suggest you to contact an attorney and take his opinion in this regard.

Thanks
