i purchased a home with someone in crosby,tx and we split up. i moved out and allowed her to keep the home so her son could stay in the same school. she wants me to sign a quiet deed and upon refusing she advised me that i have 30 days to do so or she is taking me to court and i will owe her half of the cost of the house and all money put into it. i have also put money into this house before moving out. i only let her stay because she said she could not afford to refinance at the time. what kind of rights do i have here? should i let her take me to court? dont i have some kind of interest in this property and since she lives there should'nt she be expected to pay the expenses especially since i'am paying living expenses elsewhere? my whole life savings is in this house, i would like to at least get half of it back out. can you offer any advise?by the way, i'am the primary on the house.

As your name is still mentioned in the property deed, then you would be considered as the co-owner of the property. You can demand your share of money from her and then transfer the property to her. If you sign the quit claim deed in her favor, she would become the sole owner of the property. Thus, you won't be able claim anything from her. In my opinion, you shouldn't sign the deed right away. Rather, you should speak to an attorney and take his opinion in this regard.

She has threatened to take me to court and says I will owe her for repairs to the property since I left and I will owe her half of the house as well. Is this possible? Is it possible that she at least owes me Half of what I put in. I only lived there a year and only agreed to let her stay without selling because of her son's school. I do not have the money to hire an attorney, any advise? I appreciate your help.

Hi Ret,

She cannot threaten you or force you to sign any deed. This will be considered as illegal and fraudulent. This is a legal issue and it would be better if you could get some advice from the attorney.
