an unmarried couple buys a house. eight months later they break up. both are on the deed and mortgage. she wants to refinance and take his name off of the deed and mortgage. she is pushing for him to sign a quick deed. can the quick deed by signed at the same time as the refinance. if he signs before and the refiance does not go through, he will remain on the load and would have lost any control on the property. they

such a transaction is ordinarily handled simultaneously. the quit claim deed and the mortgage would be recorded back to back, so the grantor would be assured that the refinancing transaction took place as desired.
you would have to first qualify for a refinance by yourself.
Once you are approved, you and your ex go to closing and he signs the quit claim at closing.
Then the title company will remove him through recording and the mortgage will soley be in your name.
