Hi i live in Texas. My husband has been incarcerated our whole marriage in fact we married while he was in prison. years after waiting for him i have come to the point that i can not wait any longer. I have paid my mortgage alone for all of that time and he is not on the mortgage. If i have power of attorney can i sign the release form to get him removed?

As Texas being a community property state you ought to offer him his share irrespective whether he has made any contribution to the home or not..(specially payments towards Mortgage)
So in my opinion you can hardly do anything in regard to remove his name from the deed even if you have power of attorney.
