How do I have my husband removed from the Deed.

I am going through a divorce from my husband of 3 years and we live in Texas. I purchased the home by myself during the marriage and my husband is not on the mortagage but he is on the deed. I want the house but he wants to sell. I want him off the deed, so what do I need to do? He also has refused to pay the mortgage and does not want to leave the home until the divorce is finalized, which I hear is his rights. I have an attorney but I don't think he has one..

I think this situation is very critical.

If his name on the on deed as property owner. Then you can't use quite claim deed with out his sign.

I think you must have to take help of cleaver lawyer to solve this case.

Welcome to forums!

Your husband will have to sign a quitclaim deed in order to transfer the property to you. You can offer him a certain sum of money and ask him to sign off the property in your name. If he is not ready to sign the deed, there is hardly anything that you can do. You will have to wait till the divorce decree is issued. In that decree, the judge will state what should be done with the property.
