i'm trying to re-fin on a home that is non-owner occupied and when i closed on the home 2yrs ago a survey was not done and only a legal document was filed. is it a law in tx now that requires a survey be done so i can refinance? isn't the file recorded with the county with the legal description done by a survey company described by metes and bounds good enough? does that mean everyone in texas must get a survey to refinance now?
Hi atweedieg,

An appraisal of the property is required before the lender agrees to refinance the existing home loan. The appraisal will help the lender know about the condition of the property and he will be able to decide whether or not he will approve your refinance.

Thanks

Thanks, I already have the appraisal, the title company wants a copy of the survey and everyway I turn there is a LEGAL DESCRIPTION which was called the survey, but they want a drawing and said it was a law. The title company that closed me said they do not have a drawing and the county said they do not have a drawing. Is it a law is my question.

You can contact an attorney and he will let you know whether or not it is a law to provide the legal description.
