My father died leaving a piece of property in his name only. My mother and three children survive him. My parents wanted this piece of property to pass on to me. Does this property now belong to my mother and can she will it to me? or is there a way to get the property in both hers and my name now. Will this help the transfer to me at her death? We live in Texas.

As your mother's name is not mentioned on the property deed, she does not own the land. She will have to file an affidavit of heirship and get the property transferred in her name. Once the property is transferred in her name, she can sign a quit claim deed and transfer it to you.

Thank you for your reply. We did an affidavit of heirship. It required all of Dad's heirs to be noted, my mother and siblings. Can we get the property transferred to only her name?

If your father's siblings agree to it, then the property would be transferred in your mother's name only.
If your father's siblings agree to it, then the property would be transferred in your mother's name only.
