Warrenty Deed Texas

Hello my daughter got a divorce in 2008. She lost her job last year and was not able to keep the house payments up with the child support that her ex was giving her. She was asked bye her ex to do a warranty deed. My question. Is there anyway that he can take her off the morgage paperwork. He is planning to move in the house. He tells her that it is now his house and she don't have any part in it anymore?

Your daughter's name would be removed from the mortgage docs only if her ex refinances the loan in his name. A warranty deed will only help her in removing the name from the property and not from the mortgage. Moreover, as there is a mortgage on the property, your daughter will have to sign a quit claim deed to transfer the property. Once she signs the deed, her ex would become the sole owner of the property.
