Can I claim

Posted on: 22nd Nov, 2009 12:36 pm
My husband, and his brother inheirted property from parent at time of death. I have the warranty deed in my possesion. My husband and I are now divorced. Nothing was ever put in the divorce papers concerning this property. The brother has now died, Do I have any claim to this property. We both live in Texas and property is also in Texas.
I'm not sure about Texas, but in California, which is a strict Community Property State, 100% of the property would belong to your ex-husband - you wouldn't be entitled to any of it. I suspect it's the same for Texas, but don't know for sure because Texas has some laws that are way different then the rest of the Union.
