My mother died unexpectedly in February of 07, I have lived in the house she bought me that is mortgaged in her name for 3 years now. I have continuously paid the mortgage with my checks even before her death. I have obtained the court papers appointing me administratrix of the estate. I want to keep the house, is their any possible way to turn over mortgage and property into my name without refinancing?
hi decswife,
if your mother had left a will stating you as the successor to her property, a probate is required. once the probate process is complete, you can record the deed solely in your name. however, changing the name on the mortgage may not be possible without a refinance. but once the property is changed in your name, you can request your lender to remove your mother's name from the mortgage and put yours on it.
