wills/deeds

My father passed away in Feb 2006 leaving, in his will, everything to my mother and then with her death everything is to be divided equally between their five children. Our mother's will states the same upon her death. One of those children, my one and only brother, insists against dad's will that the house and property of our parents home is his legacy and is positioning himself to ask our mom to sign the deed over to him. (This is all in Virginia) The oldest child, my sister, holds power of attorney as stated in my dad's will. Is he able to get the deed? How? And what can me and my sisters do to stop this from happening?
Hi Colleen,

Your mother is the present owner of the property. If she does not sign quitclaim deed in your brother's favor then he won't get the property. After her death, the will would be probated and the property would be divided amongst you all.

Thanks
