Quit Claim Deed (Washington state)

Posted on: 21st Apr, 2010 11:06 am
hi- i am currently going through a divorce. i purchased a house about 5 years ago in washington state. at the time my husband and i were separated but, he signed a quit claim deed to the property and is not on any mortgage documents. we reconciled for about 4 months and he lived in the home for 4 months. we have now been separated with different addresses for 3 years and are now going though the divorce. he is now asking for interest in the house because he lived there for 4 months. since he signed the quit claim deed and does not appear on any loan forms is he intitled to anything? thanks
Welcome Guest,

Though Washington is a community property state, as your husband's name is not mentioned on the property deed, I don't think he would be able to claim any equity from that property. I would suggest you to contact a real estate attorney well versed with the community property laws of your state and take his suggestions in this regard.
