we purchased our home in wa in 1999 but only my husbands name is on the loan. at closing they had me sign a quit claim deed. i am concerned that if my husband dies i will not be entitled to this property. can he quit claim it from him to us? he thinks his will will give me rights to the property but i dont think so. will the mortgage company have any say in whether he can add me or not?
Hi Bethh,
Why do you think that even if he makes a will you will not get ownership of the home?
The problem with making a quit claim deed to include you on the title is that as ownership for the house will change your lender will ask for the mortgage to be refinanced.
If the current mortgage rates are higher than what you have now, it will mean extra expenses to bear every month.

Hi Benthh,
Even after your husband's word of assurance, why do you think he will not give you the property after he passes away? If you are feeling insecure, you can ask a copy of the will from your husband and consult with an attorney regarding it.
On coming across any doubts with the will, immediately talk to your husband.
