we live in wisconsin and we lost our home to foreclosure. our lawyer told us the second mortage would go away with the foreclosure. we just found out the second mortage did not go away. will filing bankruptcy eliminate that second mortgage completely? our credit score, of course, is bad from the foreclosure, so we are not concerned about that. we have 2 auto loan payments and medical bills (don't amount to much, though).
Hi Guest,
You can file bankruptcy and get your second mortgage discharged. You can only include the second mortgage in your bankruptcy filing. However, prior to doing that, you should contact your second mortgage lender and check out if he can forgive your dues. If he agrees to it, then you won't have to file bankruptcy.
Take care.
