Does the seller have to see funds transfer from the buyer prior to signing the contract

We were on our way to sign the closing docs but the seller said because they didn't see the funds in their account of the payoff amount so they denied the signing. Is that lawful?

Yes. It's the seller's discretion whether or not to sign the closing docs. If he seeks seeks confirmed payments, then he is well within his rights to do so.

That is why a title and escrow company are used everyone signs and then the funds transfer - why the heck would you every pay someone before they signed? They dont have to sign but they wont ever sell the home until they do - go seek out a local real estate attorney and pay to have them answer - take the initial contract that everyone signed with you   Brian Barnes Mortgages in all 50 States  Brian@AimWithFocus.com - all emails answered -
