Hello Samantha, I have poa over my 86 year old mother who has mild demensia, she also is a hyphocondriac and addicted to laxitives. And i care for my 45 year old brother with downsnydrome whom still lives with her. My mother my have to go into a nursing home soon being with my health not good and hers getting worse that I can't care for both them now. Her house is paid for and hers she little savings that she wants to use on the house for some needed repairs. Then she wants to quick claim deed her home over to me. And my husband and I to move in and take care of my brother. Could we still loose the home to the state for nursing home bills, or any monies of our own that we put into the house. I am so lost on all this I also have Lupus and the stress is a killer. I don't know what to do, I don't have room in my apt. for him either. We live in TN. Thank you

If she signs a quitclaim deed to you and transfers the property, then it will make her ineligible for Medicaid benefits. It will be better if you and your mother can have a word with your attorney and check out if she can use a ladybird deed in order to transfer the property to you and your husband. This may help you get the property and it may not affect your mother's Medicaid benefits.

She could get a Reverse Mortgage on the property, and use some of the proceeds for repairs, and the rest of the money for care services, enabling her to stay in her home.  And your family could move into the home with her, and you could supplement the care services.  That'd help both of you.
