Hi there George. I have a mortgage-related question and was hoping you might be able to provide some insight regarding my unique situation. My fiance will likely be the subkjct of a foreclosure proceeding and I am concerned about the potential impact on my financial standing. The bank has not yet initiated the foreclosure process; however she has been in default of her mortgage for a year. Although she is investigating a possible deed in lieu, it is unclear if the bank will accept her offer. Due to her high income, she is not a viable candidate for Chapter 7. My question is whether the bank or creditors will be able to garnish my wages or take control of my assets should we get married prior to or after the foreclosure. She and I currently have no joint accounts of any kind and I want to make sure I can protect my assets from seizure or garnishment. For reference, her pending foreclosure would take place in the District of Columbia. Thanks in advance.

Hi Guest, If your name is not mentioned on the mortgage docs, then the lender won't be able to come after you or garnish your wages in order to recover the mortgage payments, though you get married. Your fiance's foreclosure won't have any negative impact on your credit report. Thanks
