My husband and I bought a house in DEc. of 09, due to bad credit on my part I was made to sign a disclaimer/special warrentee. After the home was his. he later signed a quit claim deed in to both of our names and we had it recorded. Our house went into forclouser and was sold in Nov. of 2010 for $8000.00 more than what was owed, even though we responed saying we wanted to modify. I was never notified of the sale so was the quit claim not valid? did they not have to notify me? is the extra money supposed to come back to us? if so who do I get ahold of..mind you we are still in the home and have herd nothing

The extra money should come back to both of you after the lender receives his dues in full. If the lender hasn't returned the money to you, then you should first contact the lender for the same. If he still does not pays it to you, then you can contact an attorney and take his opinion in this matter.
