United Cash Loans scaring enough!

I've defaulted on my payday loan and now United Cash tells me that they're sending police to get me arrested. Is that what they will really do or just threatening me? I'm already working with a credit counseling agency and trying to pay them. It's a month ago that I sent them the first late payment check even. But here I'm really troubled, can they call the police??

If it's an online payday loan company then this is quite common. These pdls often send threats to people - that's a way they use to frighten people and take more cash from them.

United Cash loans cannot call the police for defaulting on your payday loan. Don't worry, just keep making the payments.

Payday loans are unsecured and therefore the only way they can be collected is through common collection practices based on your good faith to repay the loan. They can only call/ write to you and ask for their money. They can also send your debt to collections and affect your credit score that way that is it. No police will come.

Thats ridiculous.

They cannot call police if you do not pay. If you are not able to pay then they can look for other measures but do not have the rights to get you arrested for non payment.

Hi Robertina,

You don't need to get tensed as they are only threatening you. It's good that you have started to work with a credit counseling agency and started to make the payments. You continue to make the payments and if they still create problem, you can take the help of an attorney general of your state.

I cannot believe that this payday loan company can go to such an extent of threatening you. You must file a complaint against them.

I am very thankful that you have shared your experience with them. This will help me to be alert against them as I have also taken a loan from one of such payday loan company.

They have the right to recover delinquent loans through legal remedies such as debt collection & civil court action. But you cannot go to jail for not paying your debts.

Yeah they are just using a scare tactic. I don't think thats legal to do.

Once I took a loan of $ 200 from United Cash loans. It was a great mistake that I have done. The company garnished my checking account every 2 weeks. Now, as my balance is not sufficient in the account, the bank has charged me $ 40 of NSF fees. I called my bank and told them about the illegal activities of United Cash loans. The bank has asked me to fill an ACH Affidavit Form so that they can close my account to avoid any further garnishment of cash.

This company has really made my financial situation worse.

Non Sufficient Fund (NSF) fee is a kind of checking-account fee. It is charged by banks to its customers whose accounts do not have sufficient money to cover a check. The fee charged usually ranges between $25 and $35 per check.

ACH or Automated Clearing House is an electronic fund transfer service which is used for payment of any taxes and fees.

Pay day loan companies are best known for their practice of garnishing wages. You should be careful while dealing with them.

I want to point something out that gets brushed over in a lot of forums.

Also this is not directed at anyone personally I simply think it needs to be said as it happens often.

If you default on a pay day loan you cannot go to jail. However if you did something fraudulent during the transaction then that could carry legal penalties such as jail. Below is an example...

ie. Person goes to 5 payday loan companies and promises to pay them all back out of the same money. Obviously the person will not be able to pay back all 5 they will only be able to pay back 1. This is definately illegal and can result in jail time. It is a type of banking fraud. It is like writing bad checks and cashing in on the rewards. You will definately get in trouble if you do this.

Again I am not saying this is what the original poster was saying I just wanted to bring it up as good people, who shouldn't be in jail, do try this sceme.
