time to clear out house after foreclosure hearing

No one is currently living in a home that has a foreclosure hearing scheduled for 11/04/08. How long do I have to clear out the remaining contents? Do I need to take everything I want out before that hearing?
Hi Jan,

As far as I know, a deficiency judgment can be obtained in New Jersey when a property is foreclosed. This means that the borrower will have to pay the lender the deficient amount resulting from the sale of the property. If the borrower cannot pay this amount, then the lender may place liens on his/her other property or can garnish his/her wages.

are you legally allowed to take your landscaping with you when your home is foreclosed on?

I don't think you'll be able to take the landscaping with you as the property will be foreclosed as a whole.

My dads home has already been foreclosed, just recieved auction date May, but he payed cash for the acres that the home is not on the acre the house is on belongs to morgage company, but real Q is when do we leave the house. I live in MI.

Hi farrow,

As far as I know, once the foreclosure sale is over, you will receive a notice from the lender to leave the property. You will have to leave the property within 3 days. If you need some extra time, you can negotiate with the lender and the new buyer and check out if they agree to it or not.

my dads house was forclosed on they said that they will give us time for the keys its only been seven days yet he has 40yrs of stuff in the house is ther any way i can get more time

My friend recently moved due to his mobile home being in foreclosure. His mother purchased a refrigerator 2 years ago before her death. He removed the refrigerator because he considered it a personal belonging. The owner of the mobile home park now says he wants it back. who is right here?

You can contact your lender and negotiate with him to extend the time limit. There are chances that he would be ready to increase the time-limit.

To bluebell,

I don't think the owner of the mobile home park should recover personal properties from your friend. If the owner of the mobile home park is forcing your friend to give it back, it would be better if he/she consults and attorney and take his opinion to deal with the owner.

My house has been foreclosure on and I have been given a date to vacate the property. Will I be able to move a shed off the property after the date to vacate.

The property is sold off. So I don't think you would be able to move a shed off the property after the date to vacate.

Just a few questions, can the realtor pad lock the door and not let me enter on certain dates because they cant get there and I have a court date to remove my items and cant because i cant get in and do i have the right to take my light fixtures and air conditioner and fireplace screen that is in my house since i purchased them.

Welcome to forums!

You will have to vacate the home on the date as mentioned by the court. I don't think the realtor can padlock the door before that date. I think you should inform the court with the help of your attorney that the lender is not allowing you to remove the items from the house. As far as I know, you will be able to remove the light fixtures, air conditioner and fireplace screen.

You should appoint an attorney to prepare a response to the foreclosure complaint. If you've anything to say regarding the foreclosure action or want to apply any other measures which can help you in saving property from foreclosure, the lawyer will help you in that regard.

HOMEOWNER PASSED AWAY AND AND HOUSE WILL BE FORCLOSED IN THE NEXT FEW MONTHS.DOES THE FAMILY MEMBERS HAVE A RIGHT TO TAKE OUT ALL PERSONAL ITEMS EVEN IF THEY WERE NOT WILLED TO DO THIS.
