No one is currently living in a home that has a foreclosure hearing scheduled for 11/04/08. How long do I have to clear out the remaining contents? Do I need to take everything I want out before that hearing?

The lender will foreclose the property in order to recover his balance mortgage dues. However, he won't be interested in the personal items. The family members can take out the personal items if they wish.

My house is in foreclosure, the lenders sent a realtor today to look around. Was told earlier in the week if I move by the end of the month I will get $3,000. However, today the realtor told me the oven and dishwasher has to stay, including the shears of the curtains because it comes with the house. I purchased all these items when I bought the house 20+ years ago, they belong to me. Do I have an argument? She is coming back tomorrow to pick up agreement saying I will move out by end of the month for $3,000, nothing in there says anything about those items. Thinking of telling her to shove it, or give me $500 more for each item they want to keep. Help!

my brother and his wife moved out of there house because they could not afford to pay on it they did get most of the stuff out some stuff was left that they could not get right away like pictures wedding dress toys and so on i went this past weekend to get some stuff for them and its now locked up what did they do with it and can they get it back

Well... if that was their personal items, then you will be able to take it from that property. May be the lender has locked in the property. Your brother and his wife should contact the lender, open the property and take their personal belongings.

I received a Personal Item Letter from my mortgage companyafter a final hearing for the foreclosure on my home and I went to get the rest of my items out of the home and my home had ben cleaned out. I spoke with my neighbors and they stated about 1-2 weeks ago that the mortgage company came in and cleaned it out and even took pictures. How can they do this if it was during my 30 day notice and how can they do this if it was not even the last day?

In my opinion, the mortgage company has done something illegal. You should contact a real estate attorney and take his opinion in this matter. You can check out the grounds on which you will be able to file a lawsuit against the lender.

We are working with a housing agency to get our loan modified or a forebearance but our home is in foreclosure. The first hearing is April 25th for a conference and then we received a notice today that the foreclosure hearing is on May 9. What happens at each of these stages? It can be up to 90 days before the agency has an answer on if we can get help. Will that be too late to help us?

Well, an attorney will be able to let you know as to what will happen on those 2 days. I don't think it is justified to wait for 90 days.
