How can you add name to house deed?

My husband has a mortage on our house in his name only. He is ill and I may need to get my name on the mortage. How do I do this. We really do not have a lot of money for lawyers, the last one charged 1200.00 for a POA. Please help.
Hi, we bought a property here in San Diego. Unfortunately during the process of pre-approval the loan, the broker suggested that used only my name because my husband credit history is not good. In this case, during the escrow and part of the process, my husband signed a paper transfering all the rights to me and the loan is all under my name together with the title. I want to add his name on the title. How can I do that without spending too much money in the process of adding his name in the title. Thank you.

It is possible to add your husband's name to the property title through a quit claim deed, where you will be the grantor and both you and your husband will be the grantees. However, since there is a mortgage on the property, you need to consult your lender before making any changes to the title. Adding your husband to the title without informing the lender may trigger the "acceleration" clause on the mortgage and the lender may call the entire loan amount due. However, in most cases the lenders would not mind if you add him to the title if you have been making the monthly payments satisfactorily.

hi rosa,

your mother needs to sign a quit claim deed or a warranty deed as grantor and transfer the title to both you and her as grantees. once the deed is signed, it needs to be properly notarized and recorded with the county recorder's office. this will add your name to the property deed. as the house is paid off, she will have no problem in adding you to the title.

i bought a house 10 years ago in my mother's name and her husband, now that she has passed her husband does not want to put my name on the house deed. i am the one that has paid the property taxes, and the mortgage. he does not want to add my name because he will still be responsible for the mortgage, he is not paying the mortgage, how do i go about adding my name, i can it be done as a gift, i cannot get a mortgage right now, my credit is not good, would i have to pay any taxes on that quick claim deed???? confused

Hi Karlene,

You can add your name to the title if your mother's husband agrees to sign over the home ownership to you. He can sign a quit claim deed to transfer the property to you and himself so both of you could be on the title. He can transfer the title as a gift. You will have to pay certain fees for recording the deed, but the charges are normal and there will not be any major tax consequence due to this transfer. However, given the situation, it does not look like that he would like to sign the deed. You need to convince him to do so.

It is true that he will not be removed from the mortgage. But since he is not going to make the mortgage payments, his credit will be affected in any way. If he defaults on his mortgage and the house goes into foreclosure, his credit will be ruined. So, it is better for him to add you to the title so you can continue making payments to save the house from foreclosure.

my husband and i purchased a house with his father because our credit was no good the house is in he and his wife names only. we need to add our name to the deed or something because we don't trust the other family members. they threatened us that if the parents die we will have no ownership in the house. we pay half of everything regarding the house each month. Hi shaw,

You will have to ask your husband's father and his wife to sign a quit claim deed and add your names to the property deed. Once they do so, both of you would become the owner of the property.

My boyfriend and I want together and bought a house, its paid for...but thru divorce I have to keep my name off he deed to the house. Should something happen to my boyfriend, how can we state it that the house will go to me with out my name actually being on the deed for now? thanks

Welcome Bettyjane,

You will have to file an affidavit of heirship in order to get the property transferred in your name. You boyfriend can even draft a will and declare you as the beneficiary. Thus, you will have to probate the will and get the property transferred in your name.

Hi roljacks,

You will have to sign a quit claim deed in order to add your wife to the property deed. If your property is free and clear, then you can even use a warranty deed to add your wife to the property.

Is there any way around putting the home as our primary residence since there is family member living in the home already? We have a residence that we are living in.
