My husband has a mortage on our house in his name only. He is ill and I may need to get my name on the mortage. How do I do this. We really do not have a lot of money for lawyers, the last one charged 1200.00 for a POA. Please help.
Hi MicheleNKY,
A primary residence is a property where you live for the most part of the year. Unless you fulfill this criteria, you won't be able to claim it as your primary residence.
Thanks

Can a friend transfer a property to another friend and what are the implications tax wise
My boyfriend of over a year has recently been arrested. We have currently been living together in his home which he owns. His parents happen to own the land that his house sits on. They want me to move out of the home but my boyfriend says i can stay in the home. Does his parents have any legal right to make me move out of his house just because they own the land that it sits on ?
Hi!
Welcome to forums!
To poaul,
A friend can transfer his/her property to some other friend. The friend gifting the property will be liable for paying capital gains taxes.
To Carmella,
Your boyfriend's parent's may ask you to leave the property as you're not one of the owners of the property.
Feel free to ask if you've further queries.

my mate and i have gone halves in the house but the deed is only in his name how can i get my name put onto the deed as i am part owner, i was away overseas when we purchased the new home
Hi robsartor,
You should ask your mate to sign a quitclaim deed and add your name to the property deed. This will make you one of the owners of the property.
Thanks

my ex husband has recently passed away. we got married we bought a house when we divorced i left the house to him. he did get remarried never added new wife to the deed. in his will everything was left to his mother. his mother and i are trying to get ex out of the house. my ex wanted our children to have the house. his mother said that i may still have rights to our home . what do i need to do
Hi Guest,
Your children can be considered the heirs to the property. You should contact a real estate attorney and he will guide you what you need to do in this regard.

My husband had his home before marriage to me. I want to make sure that all assests that belong to him go to me at the time of his death. This would include several cars, boats and cds. He has one daughter by another marraige. We have none together. We live in a community property state. I do realize that the home and all he has before marriage is soley his. This is what I am trying to fix. That I am joint owners with him as if we had all assets together before marraige.
Welcome susieq,
You can ask your husband to draft a will where he should mention you as the beneficiary of the property. This will help you to get the whole property after your husband's death.

I got a first time home buyer tax credit. Two years later I would like to put my husbands name on the deed. Can I do this without ramifications? I was told nothing could be done in the first three years, but don't know if just adding his name would cause a problem??
Hi Joshua,
You can add your husband's name to the property deed after 2 years. I don't think there will be any problem in doing so. But, if you have doubts, it will be better if you could contact an attorney and a tax adviser in this regard and take their opinion in this regard.
Thanks

my husband bought our home before we were married. we want to refinance the house and add my name at closing. we were told there would be a gift tax to irs on my half of the value of the home which would be quite expensive. we live in texas. i've never heard of this before.
