If my name is on the title/not the mortgage & we get divorced am I responsible 4 payments at all?...If my husband pays the mortgage and he is the only one on it but both of our names are on the title, if we divorce, can I be responsible for the $ of the house? The payments? Anything? Can it affect my credit in any way?
Hi guest,
If your name is not on the mortgage but on the title, you're not responsible for the payments. Even if you divorce, you won't be liable for the mortgage. Hopefully it won't affect your credit too as even if the house is foreclosed, it's because your husband isn't able to pay for it.
Regards,
Jessica

Hi sharon!
Welcome to forums!
If it's a community property and if the mortgage payments have been made from the community account, then you will be entitled to get half of the property. Moreover, the property deed should also have your name.
Feel free to ask if you have further queries.

Welcome Reem,
In order to know if your name is on the mortgage, you will have to check out the mortgage docs. You can check the property deed in order to know if your name is included in the title.

Welcome Goergia,
If your name is on the mortgage, then the lender can come after you in order to recover the loan payments.

If your name is not mentioned on the property deed, then you won't be able to claim any interest in the property.
Feel free to ask if you've further queries.

Hi Leslie,
As your name is mentioned on the property deed, you will have full ownership over that property. As you have mentioned that you've paid 100% mortgage, it means that the property is free and clear. So, you won't have to refinance the loan any longer as per my opinion. Whether or not you can claim the interest on your taxes is something that your tax advisor will be able to better let you know.
