If my name is on the title/not the mortgage & we get divorced am I responsible 4 payments at all?

If my name is on the title/not the mortgage & we get divorced am I responsible 4 payments at all?...If my husband pays the mortgage and he is the only one on it but both of our names are on the title, if we divorce, can I be responsible for the $ of the house? The payments? Anything? Can it affect my credit in any way?
In the Sate of Virginia - if my husband is the only one on the mortgage, am I still liable for the mortgage debt?

If your name is not mentioned on the loan, then you're not responsible for the mortgage payments.

I live in Texas. My name isn't on mortgage. Do I have to sign the sales contract if he sells my home? If he doesn't need my signature then he can sell the house for any amount to anybody. If my name isn't on the deed, am I still entitled to 1/2 since we bought the house during our marriage?

Welcome to forums!

If your name is only on the mortgage docs and not on the property deed, then you won't be liable for signing the sales contract. If your state is not a community property state, then you won't be able to claim anything if your name is not mentioned on the property deed.

what about the state of Florida. getting divorced. mortgage is in husbands name, deed is in both. house is "underwater", what am I responsible for? up til now I have contributed towards mortgage payment but want to move out. What can I do? thanks

Hi candy,

As the mortgage is in your husband's name, you're not liable for the payments. You can rather sign the quitclaim deed and transfer your share of the property to him in order to get rid of it.
