Can credit card company place lien on Social Security Check?

Can credit card company place a lien on social security check? I am on disability and social security is the only income I live on. Pls advise!

It is true that a social security income check cannot be garnished by the creditor. However, the creditor can place a lien on your property if he gets a judgment against you from the law court.

If there is a deficiency when the creditor sells the vehicle it has repossessed, then a judgment may be sought in court for that deficiency. The only time they'll attach anything is if you fail to pay according to the terms of any such judgment.

Am a senior gal. Lost my jobs. Owed back taxes to State of Ohio. Have been paying over a year. Getting behind. Attny put payments too high. He is threatning to bind up my check. Am sending what I can , but thats not good enough for him. Told him I will pay ifit takes 5 or so yrs. He wont lower payments. Help!

Hi Karalyn,

Social security checks cannot be garnished by your creditors. Your attorney will not be able to garnish your social security check. You should try and negotiate with him once again and check out if he lowers his fees so that it becomes affordable for you to pay off the dues.

My brother is going through the process of being place on Medicaid(in Illinois). His only form of income will be Social Security and that will be automatically taken for his living arrangements(goes to Medicaid). Can any remaining balance to his credit cards be taken from his only income of Social Security?

I don't think the credit card company will be able to garnish his social security income. It is exempted from garnishment.

I live in California and need to know the law regarding debt collectors putting a lien on my bank account that only deposited social security checks are deposited. Also, hubby has his own bank account but I withdraw and put it into my account to pay bills becuae he doesn't have checks. Can they put a hold n my account? Thi is the only monies we have to live on and it isn't much. Can you email me on my email address above incase I lose this sight? Thank you

The debt collector cannot garnish your social security check. However, your checking account in which the social security money is deposited can be garnished by the debt collectors in order to recover their dues.

Okay I'm gonna have to check on this one but here's what I know.

My oldest sister is on disability and is judgment proof in the state of Arizona. I'm not sure if it's a matter of her type of disability or if it's the amount of money she actually takes in. I would recommend contacting the attorney general's office.

I WOULD LIKE TO KNOW IF IT HAS BEEN 10-12 YEARS OF GETTING LETTERS FROM CREDIT CARD COMPANIES ABOUT OWING THEM MONEY CAN THEY PUT A LEIN ON YOUR BANK ACCOUNT SO YOU ARE NOT ABLE TO TOUCH ANY MONIES EVEN IF THEY CAN'T TAKE ANY EITHER CAN THEY BLOCK YOU TOO FROM NOT HAVING ANY ACCESS TO YOUR ACCOUNT EITHER AND WHEN YOU PASS THEY CAN TAKE ALL THE MONEY YOU OWED TO THEM FROM YEARS PREVIOUS? SUPPOSIDLY IN MARCH OF 2013 THE GOVERNMENT IS GOING TO ELECTRONICLY STRAIGHT DEPOSIT TO YOUR CHECKING ACCOUNT YOUR SS. CAN THE COMPANIES PUT A LEAN ON YOUR ACCOUNT? THANKS

If the SOL period for the credit card debts have been over, then the credit card company won't be able to take any legal actions against you. As they won't be able to take any legal actions, they can't place a lien on your bank account.

Social Security earnings cannot be garnished - speak directly with SS and you'll be able to learn what you need to do (it's easy) to protect your income.

As far as I know, no one can place a lien on your social security check or SSI check.
