Mobile home foreclosures or repossession - What next?

My investor who wants to repossess my home is constantly harassing me. But I am still current on my mortgage payments. If we don't pay an insurance payment and miss any property tax, they say that they will be taking our home. I am currently staying in a mobile home park. Can you tell me, if I apply to HUD will they help us pay off the loan and move into some other place?
my husband has been paying off a new mobile home that was purchased in 2007. (we are current and have never had a late payment)
My grandfather was supposed to be Co-signer for us so he could qualify for the mortgage.turns out they put my grandfather as owner and my husband as Co-signer. We don't know how that happened or if it even matters but we have been trying to sell this mobile home for a year and had no luck. We are considering walking away and letting the bank foreclose. we also pay lot rent with no signed lease. Which my grandfather has no ties with. We are wondering legally what will happen to my grandfather? Can They garnish his S.S. Or his pension? He also gets money from the VA.
What can the park do with the house if we walk away, with no signed lease? And can they do something to the home my grandfather has that he is paying his own mortgage on? Also is there a way my husband can claim bankruptcy then neither of them will be liable our would they both need to claim bankruptcy? We don't want them taking my grandfathers money. We understand that it will affect both of their credit scores for a long time(my husband has poor credit score currently my grandfather does not)but we need advice on the safest way to get out of this mobile home without anything getting garnished from my husbands salary or from my grandfathers accounts.

Hi Christy,

I think you and your husband can try and talk to the lender regarding the payment problems you are having. If possible, try to help your husband in improving his credit, so that he can get a refinancing done. This may help not only in lowering the interest rate, but also in removing the name of your grandfather from the mortgage. As for the SS or the VA, these cannot be garnished.

We are not having problems making payments, we are current and never missed one.we need a bigger house and are looking to rent. We have been working with a credit repair service for my husband for a while...what we do have problems with is medial bills from me being disabled.
My question is can my husband declare bankruptcy being he is the Co signer to relieve the debt from my grandfather and Husband or is that not possible?

Welcome chrysty,

Your husband can file a bankruptcy and get a discharge from the debts that he has in his name. But once he files bankruptcy and gets a discharge from it, he won't be able to buy a new house within the next 3-4 years.

In case of foreclosure, you will receive an eviction letter from your lender. This will help you know the time period within which you will have to leave the property.

My husband died and I am returning to PA. I bought a manufactured home three years ago and still owe 58K on it, which noone would give me for the house. My community manager suggested abandoning the place, so I assume they expect to buy it cheap. Can they go after my savings to pay the difference on my mortgage?

Welcome to forums!

The lender can come after you in order to recover the deficient balance resulting from the foreclosure sale of the property. If you can't pay off the loan, then there are high chances that the lender will come after your savings in order to recover the debts.

As far as I know, no creditor can go after your retirement account in order to recover their debts.

I got a letter stating the mortgage company is repossesing my home on the 21st. How long do I have to get out of the house? Does it have to go through some sort of court prosess?

Hi,
My aunt recently passed away leaving behind her mobile home with a $15,000 lien against it. There is little to no money in her estate. The park manager is pressuring me (as her closest kin) to continue to pay the land rent. I cannot get a copy of the terms of the lease or the loan from either agency. I need to decide if I should walk away from this home (as my aunt suggested) or try to sell it. The way I figure it I will be lucky not to lose money on a sale after the fees involved. Any advice would be greatly appreciated.
