Senior being harassed by a collection agency to repay a debt paid off in 2006. Received a "Dismissal without Prejudice." Social Security is my only income. Can they take my check?

A creditor cannot garnish your social security check. As far as the back taxes are concerned, you should contact the IRS and set up a payment plan to pay off the back taxes.

Can they garnish my ssi and/or ssd if my payments are on my direct express card. It's something fairly new from s.s. It's a pre paid debit card eventually all ssi and ssd if you don't have direct deposit will be this way they are doing away with checks.

Social security income won't be garnished. But if it is deposited in your checking account, then that can be garnished by your creditor. But in that case, the creditor will have to file a lawsuit against you and get a judgment.

May the State of California DMV garnish 96% of my bank account which contains Social Security and California Workers Compensation monies, viz., $569 out of my $591 bank account was garnished yesterday? Social Security consists of $750 auto deposited 05.18.11; worker comp consists of claim filed 01.05.11 paying $642 ($58 penalty f?or late payment) deposited 04.29.11?

A social security check cannot be garnished. But if you deposit the check in your savings/checking account, then your creditor/lender can garnish it. It won't be anything wrong.

a creditor threaten me and told me a lawsuit had been file against me for a truck that I co-signed for over 7 0r 8 years ago and I only talked to them one time. I only get social security disability. So it scared me so that I talked to a lawyer about chapter 7 to get them off me, but I have paid any money to lawyer yet, but how do I know if a lawsuit is against me and should I just leave chapter 7 alone.

You can check your local civil court clerk's office in order to know whether or not there is a lawsuit filed against you.
