change of name / ownership on deed

If my dad wants to put his property into my name can he do a quit-claim form signing it over to me?
My father passed, and the house I live in has his name and my name listed. There is no MORTGAGE on the house, however my step-mother is having fits over who's house it is. The Trustee's office shows just my name, and my fathers. From what I saw from the lawyer we are seeing, he quit-claimed the deed to me in his will. it was recorded and notarized.
What do I need to do, and when, to make sure the house is actually mine?

Hi Kenneth,

If there is a quitclaim deed which mentions you as the sole owner of the property, then it will be considered as your property. Your step-mother won't be able to claim any ownership rights over that property.

Great, glad to see that information.

There's also a question as to who owns tools, and a riding lawn tractor.
They are both on the property from the above post.

My step mother came banging on my houses back door the other day, demanding she get into the sheds, which houses the tools and lawn tractor. At the request of the exectior (sp?), we changed locked on the sheds.
Since those are on the property that was quit-claimed over, does she also have no claim to that?

What rights do I have? She thinks she owns everything, and we are having to go to probate court over this.

Hi Kenneth,

If the step-mother's name is not mentioned on the quitclaim deed, then she won't be able to claim anything. She can't even claim the tools and lawn tractor that is kept in the shed.

we live in pa and own our home mortgage free. we are joint tenants on the deed, but we would like to add "with right of survivorship" to our current deed to avoid probate. can we change the titla on our deed with a notarized affidavit or do we have to submit a quit claim deed?

Welcome to the forums!

As far as I know, both of you will have to submit a fresh quitclaim deed with rectified terms. You can contact a real estate attorney and he will help you in rectifying the deed.

Hi my father is deceased and when he passed the deed was then put in my mothers name and my mother is now deceased. I already have an affidavit of heirship. My mother and father had 2 children and my father had 4 step children. What do i need to do now in order to get the deed transfered in my name and I live in the state of Texas
