Get someone off the title of a house

My daughter was living with a man for 10 years. They bought a house together. Both their names are on it. They broke up, he does not want the house. How does she get him off the taxes & the mortgage.
My mom has dementia and my brother and her were both on the house title. My brother somehow took my mom off the title. Can that legally happen? My mom lives in an assisted living place and my brother does not want a lien put on the house for her care. Now my mom does not qualify for care.

If your mother has dementia, then your brother may not be able to remove her from the property title. You should contact a real estate attorney in order to find out whether or not your brother will be able to transfer the property in his name when your mother has dementia.

My father died with his name on a deed to property that was forfeited for not paying back taxes. His deed is the only deed on file and my name is not on it.I don't want the property.Do I have to own it if I am the only survivor? He has been dead for 24 years.

It is not mandatory for you to own the property. Moreover, you have mentioned that the property was already forfeited for the non-payment of taxes. In such a situation, you're not liable to get the property transferred in your name.

me an my wife adopt a our son and put his name on our house deed,my wife past away 10 yrs now i have not seen my son fo that time .till when i got remarried now i want to leave my house to my wife but his name is on the deed how can i remove his name .as i know that he will not sign as all he want is everything i got . he is a greedy man . please help me

My son and his girlfriend bought a house 3 years ago. The house title is in both of their names but his credit was bad so the mortage is in her name. Now, she is leaving him but will give him the house if he can get the mortage in his name so she can move on, but he still will probably not be able to get one because of debt to income ratio. Any ideas of what to do?(or how to do it) THANKS!!!

hi sealley,

if you have a good debt to income ratio and meet all the other criteria of the lender, then you can cosign for the loan and help your son get qualified for a mortgage refinance.

My mother added my brother to her title in 1998 4 years after buying home. Because he lived with her and he wanted to use the house as write off and claim her as a dependant because she is retired and now 76yrs old..But what just realized the other day is that he wrote joint title on the deed...I was looking at her WILL and saw that she was willing her 50% share to me and my other brother..But we just found out today that she can't will her share she feels betrayed by my brother and wants to change it to tenants in common or possibly remove the off the title. She feels he may not sign the title to be removed or changed. She always want the house to be shared 3 way among her children. What can we do..He does not care about us at all.

Your mother should immediately get in touch with a real estate attorney and take his opinion in this regard. The real estate attorney will be able to better help you in this regard.

I got a large settlement, I bought a home and car put mine and my boyfriends name's on title. he is now verbal abbusive i want him out :x . can i get his name off both titles?

Hi shannonmiller,

Unless he signs a quitclaim deed and removes his name from the property and the car, you won't be able to remove him from both titles.

Hi I bought a house with only my name n mortgage but boyfriend insisted that he be on title and deed. Now he don't want to let me do anything cause its his house too he's on title and deed. I want him out but he won't sign quick claim deed and doesn't pay mortgage what can I do?

Well, you can get rid of the property. You can file a partition lawsuit and sell off the property through court's order.
